Terms of Service

By accessing or using Texloom Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

To use certain features of our Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Paid Subscriptions:
Some features require a paid subscription. By subscribing, you agree to pay the applicable fees.

Billing Cycle:
Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.

Credits:
Credits are the currency used to process images. Purchased credits never expire. Monthly plan credits are added fresh each billing cycle.

Cancellation:
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

Refunds:
Refunds are handled on a case-by-case basis. Please refer to our Refund Policy for details.

Price Changes:
We may change our prices with 30 days' notice. Continued use after price changes constitutes acceptance.

Currency, Taxes, and International Customers:
- India (INR): Prices are inclusive of 18% GST (CGST + SGST for intra-state, or IGST for inter-state) under SAC 998315. A GST-compliant tax invoice is issued for every order.
- Outside India (USD): Prices are in US Dollars and do not include any local taxes, VAT, GST, sales tax, customs duty, or similar charges. Texloom Studio is registered in India and does not collect, withhold, or remit taxes on behalf of customers in any other jurisdiction. You are solely responsible for determining and paying any taxes that may apply to your purchase under the laws of your country, state, or province.
- Currency conversion: If your card or bank settles in a currency other than USD, your bank's foreign-exchange rate and any associated fees apply. We are not responsible for those charges.
- Payments: All payments are processed by an RBI-licensed payment gateway that supports both Indian and international cards. We do not store full card numbers ourselves — only the gateway's tokenized reference, last-four digits, and card brand for receipt generation.

Your Content:
You retain all rights to the images and designs you upload to our Service. By uploading content, you grant us a limited license to process, transform, and display your content solely for the purpose of providing our services.

Our Content:
The Service and its original content (excluding user content), features, and functionality are owned by Texloom Studio and are protected by international copyright, trademark, and other intellectual property laws.

Generated Content (you own it):
You own every output our AI tools generate from your inputs. We claim no intellectual-property rights over the generated images and we will not assert any. You may use generated outputs for any lawful purpose, including commercial use (selling, licensing, printing, distributing) on every plan tier — there is no separate "commercial license" upgrade.

Your responsibility for outputs:
You're responsible for the inputs you provide and the use you make of outputs. You must not use generated outputs in ways that infringe third-party intellectual property, defame real people, impersonate identifiable individuals without consent, or otherwise violate applicable law. Generated outputs may inadvertently resemble existing copyrighted works; you are expected to do reasonable diligence (a quick reverse-image search) before commercial use of high-risk outputs (logos, character art, branded designs).

We don't train on your data:
We do not use your uploaded inputs or generated outputs to train any AI model — ours, our third-party AI inference providers', or any other party's. Inputs and outputs are processed for the single purpose of returning your result. After your plan's retention window expires, output files are deleted from our cloud storage; nothing is retained for training.

You agree not to use the Service to:

• Upload content that infringes on intellectual property rights
• Generate illegal, harmful, or offensive content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper working of the Service
• Use automated systems to access the Service without permission
• Transmit viruses or malicious code
• Collect user information without consent
• Engage in any activity that violates applicable laws

We reserve the right to remove content and suspend accounts that violate these terms.

Responsibility:
You are solely responsible for the content you upload, including ensuring you have the right to use it.

Content Guidelines:
- Do not upload copyrighted material without permission
- Do not upload content containing personal information of others without consent
- Do not upload illegal or offensive content

Removal:
We may remove content that violates these Terms without notice.

Texloom Studio does not currently offer a public API. All tools are accessed through the web application. If API access is introduced in the future, additional terms will apply.

Texloom Studio uses generative and machine-learning AI to power tools like pattern generation, upscaling, vectorization, background removal, color matching, and design extension. By using these tools you understand that:

• No guarantee of accuracy. AI output is probabilistic. Generated images, suggested colors, vector traces, separation channels, and pattern repeats may contain visible artifacts, color drift, or print-unsuitable detail. You are responsible for reviewing every output before using it for production, sampling, or sale.
• Pre-press review is your responsibility. For screen-print, rotary, sublimation, or digital textile printing, always run a physical strike-off or proof before a production run. We do not accept liability for production losses caused by relying on AI output without proof verification.
• No medical, legal, or safety use. Texloom is a creative-design tool. AI output must not be used in any context where inaccuracy could cause harm.
• Output ownership. Subject to your compliance with these Terms and applicable IP law (see Intellectual Property), you own the AI outputs you generate. We claim no ownership over generated designs.
• Indemnity for misuse. If your prompts or uploads cause us to generate content that infringes third-party rights (copyright, trademark, publicity), you indemnify us per the Indemnification section.

Several Texloom tools (Color Standards, Color Matching, Separation Studio, Pantone Colors) reference industry color libraries — including the Pantone TCX/TPX, Pantone Solid Coated, RAL Classic, and similar systems — to help you match designs to recognized printing standards.

• Reference-only use. PANTONE® and the Pantone color names/numbers are trademarks of Pantone LLC, used here strictly for color reference and identification. RAL is a trademark of RAL gGmbH, used the same way.
• No affiliation or endorsement. Texloom Studio is not affiliated with, endorsed by, or sponsored by Pantone LLC, RAL, or any other color-system owner.
• No color guarantee. On-screen color is approximate. Always verify against an authentic Pantone or RAL physical guide before approving production color matches — display calibration, browser color management, and printer profiles all introduce drift.
• Trademark restrictions. You may not use the Pantone name, Pantone color numbers, or RAL designations to imply official certification of your designs unless you separately license that right from the trademark owner.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:
- The Service will be uninterrupted or error-free
- Results obtained from the Service will be accurate
- The Service will meet your requirements

Your use of the Service is at your sole risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXLOOM STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or revenue
• Loss of data
• Business interruption
• Loss of goodwill

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Texloom Studio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

• Breach of these Terms
• Conduct that we believe is harmful to other users or our business
• At our sole discretion, for any reason

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Batala, Punjab, India.

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for material changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.
